These Terms of Service ("Terms") govern your use of the website located at www.jenloyerboudoir.com and your engagement with the photography services provided by Jen Loyer Boudoir LLC ("Company," "we," "us," or "our"). By accessing this website or booking services with us, you agree to be bound by these Terms. If you do not agree, please do not use this website or book our services.

1. SERVICES

Jen Loyer Boudoir LLC is a professional boudoir photography studio located in Prescott, Arizona. We provide in-studio boudoir photography sessions, image products, and related services to clients 18 years of age or older. All services are subject to availability and are confirmed only upon receipt of a non-refundable retainer and execution of a client agreement.

2. ELIGIBILITY

You must be at least 18 years of age to book or receive services from Jen Loyer Boudoir LLC. By booking a session, you confirm that you meet this age requirement. We reserve the right to request valid government-issued photo identification at any time.

3. RETAINER AND BOOKING

A non-refundable retainer is required to reserve your session date. This retainer is earned by Jen Loyer Boudoir LLC upon receipt and is applied toward your collection purchase as specified in your booking agreement. Session dates are not held without a paid retainer. The retainer is non-refundable under all circumstances, including cancellation by the client.

4. PAYMENT TERMS

Full payment is required prior to your session. Clients may choose one of the following payment options:

Pre-Session Payment Plan (PSPP): A structured payment plan with all installments completed prior to your session date, as outlined in your booking agreement.

Payment in Full: Full collection payment is due no later than 30 days before your session date. A 5% discount is applied for payment in full.

No payment plans are available after your session date. All balances must be paid in full before images are delivered or products are ordered. Jen Loyer Boudoir LLC reserves the right to withhold image delivery until payment is received in full.

5. CANCELLATIONS AND RESCHEDULING

Client Cancellation: If a client cancels for any reason, all payments made to date are non-refundable, including the retainer and any collection payments.

Client Rescheduling: Rescheduling requests must be made at least 72 hours in advance of your session date. Rescheduling is subject to availability and is not guaranteed. We will make every reasonable effort to accommodate rescheduled sessions.

No-Shows: Failure to appear for your scheduled session without prior notice will result in forfeiture of all payments made, including the retainer and any collection payments.

Studio Cancellation: In the rare event that Jen Loyer Boudoir LLC must cancel a scheduled session due to circumstances within our control, we will offer the client a full rescheduling opportunity. The retainer is non-refundable in this circumstance as it was earned upon booking; however, any collection payments made will be refunded in full.

6. IMAGE OWNERSHIP AND COPYRIGHT

All images created during your session are and shall remain the exclusive intellectual property of Jen Loyer Boudoir LLC. Clients receive a personal use license for images included in their purchased collection. Images may not be resold, distributed commercially, altered, or used for any purpose other than personal enjoyment without the prior written permission of Jen Loyer Boudoir LLC.

7. MODEL RELEASE

Jen Loyer Boudoir LLC will not share, publish, display, or use client session images for portfolio, website, social media, advertising, or any other marketing purposes without a separately signed model release. Signing a model release is entirely voluntary and is never a condition of booking or receiving services.

8. PROMOTIONAL OFFERINGS

From time to time, Jen Loyer Boudoir LLC may offer promotional pricing, seasonal specials, founding client rates, or limited-time offers. These offerings are subject to availability and may be modified or discontinued at any time without notice. The specific terms, pricing, eligibility requirements, and conditions of each promotional offering will be communicated at the time of the offer. Promotional terms supersede these general Terms where applicable.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Jen Loyer Boudoir LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

10. PRIVACY

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved in the state or federal courts located in Yavapai County, Arizona, and you hereby consent to personal jurisdiction in those courts.

12. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated effective date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. ENTIRE AGREEMENT

These Terms, together with your signed client agreement and our Privacy Policy, constitute the entire agreement between you and Jen Loyer Boudoir LLC with respect to your use of our website and services, and supersede all prior agreements and understandings.
